TERMS & CONDITIONS

Park Cities Pet Sitter, Inc., doing business as Park Cities Pet Care

Effective date: August 1, 2026


We pet sit every day of the year, and we keep two sets of hours. Our office hours, for booking, scheduling, billing, and questions, are 9:00am to 5:00pm Monday through Thursday and 9:00am to 4:00pm on Fridays, and you can reach our office by phone, text, or email during those hours. Our pet care visits are scheduled seven days a week, generally between 7:00am and 10:00pm. We do not provide around the clock or after hours on call coverage.


These Terms and Conditions govern your use of the Park Cities Pet Sitter, Inc. (PCPSI) website, our web based and mobile application and client portal, our content, and the pet care services we offer, including services offered through third parties that integrate our functionality (together, the "Services"). PCPSI, doing business as Park Cities Pet Care ("PCPSI," "Park Cities Pet Care," "we," "us," or "our"), provides the Services. "You" refers to you as a user of the Services and as our client. We are a professional pet care company that stands behind the Services we provide, and the caregivers who serve you are our employees. We may from time to time engage independent contractors, vendors, or agents for other parts of our business. Where these Terms refer to our team, that means our employees together with any such contractors or agents we engage.


PART A. USING OUR WEBSITE AND APP


1. Acceptance of these Terms

By using or accessing the Services, you acknowledge that you have read, understood, and agree to these Terms and Conditions. If you do not agree, please do not use the Services. When you become a client, we may also ask you to accept these Terms and any service agreement in our client portal, and that acceptance confirms your agreement.


2. Changes to these Terms

We may amend these Terms and update the Services from time to time, in our sole discretion. If we change these Terms, we will post the revised version on our website and in our scheduling software. Changes take effect on the revision date shown. Please review the Terms periodically. Your continued use of the Services means you accept the updated Terms.


3. Eligibility and who may book

You must be at least 18 years old and able to enter a binding contract to book Services. Only individuals you have designated on your account may make or change reservations. For liability reasons, we cannot provide service if an unsupervised person under the age of 18 will be on the property. If a caregiver arrives and finds an unsupervised minor on the property, the caregiver will leave, and no credit will be given for the attempted visit.


4. Our app and client portal

Once you become a client, most of your day to day interaction with us happens through our client portal, which we provide under the Park Cities Pet Care name. The portal is available on the web and as a mobile app, and both are part of the same system. You use it to manage your profile and pets, request and review visits, receive visit updates and photos, communicate with us, and handle billing. You are responsible for keeping your login secure and for using the portal only for its intended purpose. The portal is provided and maintained by a third party technology provider. We control how we use it to serve you, but we do not control the underlying software, which may be updated, changed, or temporarily unavailable because of that provider or for other reasons outside our control. We are not responsible for those interruptions.


5. Keeping your information current

It is your responsibility to keep your contact, pet, pet care, home care, payment, and emergency contact information accurate and current in your online profile, and to update it as things change. We rely on this information to care for your pet and home.


6. Intellectual property

The website, app, and their content, including text, graphics, logos, and images, are owned by or licensed to PCPSI and are protected by law. You may not copy, reproduce, or use our content or marks without our prior written permission, except as normally permitted for viewing the website.


7. Third party links

Our website and app may link to third party websites and services, such as our payment processor. We are not responsible for the content, policies, or practices of third party services. Your use of those services is governed by their own terms and privacy policies.


PART B. OUR SERVICES AND YOUR BOOKINGS


8. Booking and scheduling

All requests for service must be made through one of these methods, and we cannot accept requests made any other way: through our online scheduling software, available in your client portal; by email at pets@parkcitiespetcare.com; or by phone or text at our main office, (214) 828-0192. Our online system accepts reservations made with more than 48 hours notice. For service needed sooner than that, please contact our office directly by phone or text, and we will do our best to accommodate you based on availability.


The caregiver assigned to your Service does not control their own schedule and cannot accept reservations, changes, or cancellations, so please do not contact them about scheduling. If you have a time sensitive request, please contact our office directly and we will do our best to help based on availability.


9. Confirmations and advance booking

We generally confirm reservations within 24 to 72 hours after we receive them. If you do not receive a confirmation within that time, please call, text, or email us. While we try to be as accommodating as possible, we cannot guarantee service without adequate notice at any time of year, and service booked on short notice is subject to last minute fees. During national holidays and peak periods, we recommend booking as early as possible. We recommend booking Tuck-in Service at least one to two months in advance, as staffing is limited.


10. Fees and payment

Payment is due at the time of service. For ease of payment, you may keep a credit card or ACH information on file in your online profile, and you authorize us to charge it for Services and any amounts you owe. We accept major credit cards. If payment is not made at the time of service, a late payment fee applies. Past due balances bear interest at one and one half percent per month. You agree to reimburse us for any expenses, including legal and collection agency fees, that we incur in collecting past due amounts.


Our current rates and fees are posted on the Rates page of our website. Fees are subject to change for future service.


11. Last minute, holiday, and additional fees

Additional fees may apply for service booked on short notice, for service during holidays and peak periods, for service outside our normal route areas, for administering certain medications, for watering a large number of plants, for extended service during emergencies or cleanup, and for other special considerations. The holidays and peak periods we observe, the days they cover, and all current amounts are listed on the Rates page of our website.


12. Deposits for Tuck-in and holiday bookings

Tuck-in Service and certain holiday bookings may require a non refundable deposit at the time of booking, as described on the Rates page. During holiday periods, cancellations of Tuck-in Service must be made at least two weeks in advance to avoid a full charge, and no refund is given once the service has begun.


13. Cancellations and refunds

For non holiday and non peak service, we require at least 24 hours notice to cancel. Service canceled the same day is not refunded; however, any remaining visits beyond that day are held as a credit on your account. During holiday and peak periods, as determined by our office, all cancellations other than Tuck-in Service should be made at least one week before the scheduled service to avoid charges. Last minute cancellations during holiday and peak periods are subject to a cancellation fee as posted on the Rates page, and no refund is given once the service has begun.


Extenuating circumstances. We understand that serious, unexpected events happen. At our discretion, we may waive or reduce cancellation charges when you must cancel because of a genuine circumstance beyond your control, such as a natural disaster, a government mandated obligation, or the serious illness or death of a member of your household or your pet. We may ask for reasonable supporting information.


14. Keys, fobs, and property access

These Terms authorize us to enter your home to provide the Services. For reliable, secure service, we recommend keeping keys on file with our office, which we find safer than leaving keys outside the home. We request two keys on file, one for our office and one for your caregiver. If you provide only one key, we may have a duplicate made and charge a key fee as posted on the Rates page. If you prefer not to keep keys on file, we can arrange pickup or drop off for an additional fee, or you may drop keys at one of our offices.


We retain your keys and any access devices, properly secured, until you ask for their return. If an access device malfunctions through no fault of ours, you authorize us to use a locksmith to gain entry, and you agree to reimburse those costs. For homes with electronic only entry or concierge provided access, please provide access details in advance. If securing access through a concierge or leasing office adds time to a visit, that time is part of the visit, and lengthy waits may incur an additional charge. To have keys or devices returned, you may pick them up at our office at no charge, or have them mailed or delivered for a fee as posted on the Rates page.


15. Visit windows, parking, and supplies

When scheduling visits, we ask for a reasonable window of time, usually about two hours. We cannot commit to exact times, but we do our best to accommodate your pet's routine. You are responsible for providing reasonable parking and access for our staff. Where on site or nearby parking is unavailable, we may charge for the additional time needed to park and reach your home, and if a staff member must pay to park, you agree to reimburse those charges. Please keep adequate pet supplies on hand for the full length of service. If something runs out, we will replace it, and a shopping fee plus the cost of the items will apply.


16. How we provide care

We perform Services as outlined in your Client, Home, and Pet records in your online account.


Walking. We walk most dogs that enjoy walking. If a dog fights the leash, pulls constantly, chases other animals, or shows aggressive behavior, we may not be able to walk it safely, and we will reach out to discuss options. While in our care and not in a secure area such as your home or yard, dogs must remain leashed at all times, to comply with city ordinance and keep everyone safe. For safety, our staff do not use retractable leashes; please provide a standard four to six foot leash. Please provide waste bags and tell us where to dispose of waste, as most ordinances require waste to be picked up in public and common areas.


Dog parks. For health and safety reasons, our staff do not take client dogs to dog parks.


Shared responsibility. If you choose to have anyone else share pet or home care duties with our staff, we require that person's name and contact information and a written log on site recording what each party did and when. We are not responsible for damage to your home or pets when care is shared. If we believe the other party is not performing their duties, we may add visits and charge accordingly.


Plant watering. From May through September, we water outdoor plants only before 10:00am or after 6:00pm, for the health of the plants. We are not plant experts and are not responsible for plants that are damaged or die during our care.


Substitutions. If a requested caregiver is unavailable, we will arrange another team member to provide the Service. We cannot guarantee in every case that you will be notified of or meet a substitute in advance.


Use of bathrooms. Our staff keep the use of client bathrooms to a minimum, but there are times when it is unavoidable.


17. Others staying in or accessing your home

Please tell us in advance about anyone who will be staying in your home or have access to it during your service dates, even if they are not helping care for your pets, and give us their name and phone number so we can reach them if needed. Others in the home can affect your pet's routine and safety, for example by letting a pet outside or taking a pet somewhere, and we are not responsible for a pet's escape, injury, loss, or other issues caused by anyone other than our team. When a guest or other person is present and your pet's needs for the visit have been met, our caregiver may end the visit and leave rather than remain for the full scheduled time, since we cannot always predict when others will be there.


18. Emergency and veterinary care

If your pet requires medication or has an aged or infirm condition, please discuss its needs with us in advance. If your pet shows signs of illness or injury, or we have difficulty medicating it, we may take it to your veterinarian or the nearest emergency clinic, using our best judgment. We will try to reach you first, but we never take chances with a sick or injured pet. You authorize us to transport your pet to your veterinarian, or another who is available, when we judge it necessary. You are solely responsible for all veterinary costs and agree to reimburse us for any veterinary charges we advance. You release us and our team from liability related to the transportation, treatment, and expense arising from veterinary care, except for our gross negligence. In the event of severe weather or a state of emergency, you authorize us to use our best judgment in caring for your pet and home.


19. Severe and inclement weather

The safety of the pets in our care and our team comes first. During extreme heat, extreme cold, heavy rain, ice, storms, or other hazardous conditions, we may shorten, reschedule, or adjust visits using our best judgment for your pet's wellbeing. In hot weather, we may limit a walk to a shorter potty break, walk earlier or later in the day, avoid hot pavement, and make sure your pet has water and shade. As a general rule, if the pavement is too hot to hold your hand on it for several seconds, it is too hot for your pet's paws. In cold weather, we may shorten time outdoors, especially for young, older, short haired, or unwell pets. If it is too hot or too cold for a person to be comfortable outside, it is likely the same for your pet. We do not provide credit for same day cancellations you request due to weather unless there is a genuine safety issue in providing service. A request to move a visit to a different time on the same day may incur an additional visit charge.


20. Your pet and your warranties

You represent and warrant that your pets have no history of biting, nipping, or vicious behavior, that they are currently vaccinated as required by law, and that you have disclosed any medical, dietary, or behavioral condition relevant to their care. You agree to pay for any medical expenses or damage to persons or property caused by your pets. You agree to indemnify, hold harmless, and defend us and our team from any claim arising from the actions of you or your pets, whether or not a bite or vicious history exists. We may decline or discontinue Services for any pet we reasonably believe poses a safety risk.


21. Cameras in your home

You are welcome to use cameras in your home for security. If cameras are located in a bathroom, or in a bedroom where a member of our team will stay during an overnight or Tuck-in stay, you must notify us and tell us how to disable them.


22. Photos of your pet

From time to time we take photos of client pets for our social media and marketing. We do not use photos that would identify you or the location of your home. If you would like your pet excluded from this use, please contact our office.


23. Our employees and non solicitation

You may contact your caregiver directly about the details of caring for your pet and home, but not about scheduling, which they do not control. Please do not solicit our employees for pet care services outside of Park Cities Pet Care. Our employees are subject to a non solicitation and non compete provision in their employment agreement for one year after they leave the company, during which they may not work, directly or indirectly, for any client they served while employed with us. If you hire one of our employees directly in violation of this policy, you will no longer be protected under our bonding and liability insurance, and we can no longer guarantee your service. If an employee solicits you directly for outside pet care, please report it to our office.


24. Account inactivity

If you do not use our Services for two years or longer, we may deactivate your online account and securely dispose of your keys and access devices. Any unused service credit must be used within two years, after which it is no longer valid.


PART C. LEGAL TERMS


25. Liability for pet and home care

We carry general liability insurance and are bonded. We and our team will not be liable for the injury, disappearance, or death of any pet unless due to our gross negligence. We and our team will not be responsible for damage to your property, or the property of others, caused by your pets during the period they are in our care, unless due to our gross negligence. If you choose to have a third party, such as a friend, relative, or neighbor, share pet or home care duties, we are not responsible for any damage to your home or pets.


26. Indemnification

You agree to indemnify, hold harmless, and defend us and our employees from any claim, damage, loss, liability, and reasonable cost, including attorney's fees, arising from the actions of you or your pets, your breach of these Terms or your service agreement, your failure to disclose relevant pet or home information, or the acts of third parties you have allowed access to your home. This does not require you to indemnify us for loss caused by our own gross negligence.


27. Disclaimers and no guarantee

The website, app, and Services are provided on an as is and as available basis. To the fullest extent permitted by law, we disclaim implied warranties, including the implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the website or portal will be uninterrupted, error free, or secure, and we cannot guarantee service without adequate notice. This section does not limit any rights you have under applicable law that cannot be waived.


28. Limitation of liability

To the fullest extent permitted by law, and except for loss caused by our gross negligence, our total liability arising out of or relating to any Service will not exceed the amount you paid us for the specific Service that gave rise to the claim, and we will not be liable for any indirect, incidental, special, consequential, or punitive damages. Nothing in these Terms limits liability that cannot be excluded under Texas law.


29. Governing law, mediation, and disputes

These Terms are governed by the laws of the State of Texas, excluding its conflict of laws rules. If a dispute arises, the parties agree to first submit the dispute to mediation in good faith before starting any litigation, and any mediator chosen will follow the mediation rules and procedures of the American Arbitration Association. If the dispute is not resolved through mediation, the exclusive venue for any action will be the state or federal courts located in Dallas County, Texas, and both parties consent to that jurisdiction. To the extent permitted by law, both parties waive any right to a jury trial, and in any action to enforce these Terms the prevailing party may recover its reasonable attorney's fees and costs.
